The obligation to have halal certification aims to provide consumer protection and provide convenience for product producers. Law Number 33 of 2014, Article 4, clearly states that all products entering, circulating, and traded in the territory of Indonesia must be halal certified, with clear limitations and provisions.
According to Article 1 of the Law, products are goods and/or services related to food, beverages, medicines, cosmetics, chemical products, biological products, genetically engineered products, and goods used, utilized, or utilized by the public. While services include slaughtering, processing, storage, packaging, distribution, sales, and/or presentation. Furthermore, Article 24 states that business actors are required to have a halal supervisor.
Consumption of a product is a choice. Halal products may be circulated with halal certification. Non-halal products may also be circulated as long as they include a statement that they are not halal. Therefore, halal certification is a profitable investment for business actors, both in terms of business and consumer trust, for several reasons:
Decree of the Minister of Religious Affairs (KMA) Number 748 of 2021 and KMA Number 944 of 2024 were issued with the consideration of providing guidelines and legal certainty regarding the types of products that must be halal certified and realizing administrative order in the implementation of halal product assurance.
There are two (2) schemes for obtaining halal certification, namely the self-declare scheme and the regular scheme. The regular scheme applies generally to (i) all types of business actors (micro, small, medium and large) and (ii) all types of products.
Meanwhile, the self-declare scheme is only specifically for (i) micro and small business actors and (ii) products that are not at risk in the types of food and beverage products stated in the Decree of the Head of the BPJPH Agency No. 22/2023.
